Parents Charged With Retail Fraud See Dismissal

Jul 18, 2016, by Martin Drias in Case Results, Criminal Defense, Theft

Everyone experiences stressful situations and it is very easy to make mistakes when a person is already frustrated or filled with anxiety. Unfortunately, these momentary lapses can result in criminal charges, thereby compounding a person’s worries. For example, a husband and wife were in a local department store with their children, when their young children began acting out and started crying while they were selecting clothing. In the confusion some articles that they had intended to pay for were overlooked in their stroller and the pair were charged with retail fraud or shoplifting. The two were very embarrassed and knew that a theft conviction would create significant problems for them because neither was a U. S. citizen and theft is considered a crime of moral turpitude or dishonesty, carrying the possibility of deportation. In an effort to deal with the charges against them and remain in the United States, the couple retained the experienced criminal defense attorneys with Drias Law Group.

After taking their case, attorney Martin Drias set to work so these parents would not be unnecessarily burdened by this incident. While he prepared to defend the pair at trial, attorney Davis also negotiated with the prosecutor to find an alternate outcome. Eventually, these discussions concluded and by relating the original circumstances, attorney Davis succeeded in convincing the prosecutor that the entire situation was a misunderstanding. As a result, the retail fraud charges were dismissed in their entirety and the two parents could move on with their lives.

The outcome of an individual case depends on a variety of factors unique to that case. Case results do not guarantee or predict a similar result in any similar or future case.
