Man Found Not Guilty on Felony Assault & Domestic Violence Charges
May 14, 2015, by Case Results, Domestic Violence inWe were recently contacted by a 48-year-old man arrested and charged with assault with intent to do great bodily harm and domestic violence. Both of these offenses were charged as felonies.
Unfortunately, the man had several prior felony convictions on his record. If convicted, he faced serious consequences, including substantial prison time. Concerned with avoiding prison time, he consulted with the Michigan assault lawyers at Drias Law Group PLLC to see if we could help.
Our client was accused of contributing to his ex-girlfriend’s injuries during a physical confrontation she had with his current girlfriend, and the alleged victim sustained a fractured arm requiring surgery. The case was being heard by a judge known to be tough against domestic violence cases in this area. Our client was offered a reduced charge of misdemeanor domestic violence and misdemeanor assault by the prosecuting attorney.
Attorney Martin Drias, however, reviewed the evidence against our client and fought these charges. The evidence was weak and the witness’ credibility was questionable. With that in mind, he moved to push this case to trial given the State’s weak evidence.
